I wish he makes way and hopefully some moderate does something for the immigrant community.

The Barack Obama Administration recently announced that border guards at United States Ports of Entry (POE) will begin screening aliens arriving from certain countries based on specific information about threats to the USA. The immigration attorneys at Los Angeles' Fong & Chun immigration law firm are advocates for national security balanced against sensible protections for civil rights. We hope this change will reduce the number of unwarranted, unreasonable, and (usually) unfriendly challenges to certain arriving visitors.
Since the New York terrorist attack in September 2001, the USA has maintained a list of approximately fourteen countries (the so-called "group of fourteen") which are considered to encourage state-sponsored terrorism, or which are believed to provide assistance to terrorists. The US would not even officially name the specific countries, or confirm the exact number of countries, on the list. All citizens of one of these countries -- of any gender, any age, any social class, any educational level, for any reason -- would be subjected to additional interrogation by US Border Guards.
The newly-announced change sets up a system which uses intelligence information and threat assessment -- about specific persons, specific targets, and specific descriptions, to identify passengers who might have a link to terrorism. Quite properly, those persons would be subjected to additional scrutiny. Others who do not meet the more reasoned threat profiles would be allowed to enter the USA in the way of other visitors.
For example: most people in the know would say that the Islamic Republic of Iran was part of the group of fourteen. All citizens from Iran -- absolutely all -- would be pulled aside and interrogated at POEs. Under the new system, if the US has specific information about a 26-year old male Iranian student, or an Iranian woman with a certain name, or even someone with a partial passport number, then persons meeting those descriptions will be pulled aside. One of my friend was in a similar situtation.His attorney filed h1 extension providng the proof that a previous labor application was denied and the new one has been filed and is pending . He was able to get his h1 extended for an year.His situation was far worse , he had only a month left on his h1.

Here is a quick update from the California Service Center regarding this new fee. The additional filing fees of $2,000 for certain H-1B petitions and $2,250 for certain L- 1A and L-1B petitions is applicable to petitioning employers who employ 50 or more employees in the United States and 50% of the petitioner�s employees are in H-1B, L-1A or L-1B status. The PL 111-230 fees do not apply to petitions requesting an extension of H-1B, L-1A or L-1B status with the same employer (only for initial filings for a new beneficiary).
When the fee is not required, it is critical that the petitioner explicitly acknowledge this and explain why it is not required in the I-129 filing. If this is not done, USCIS will likely issue a Request for Evidence asking for a statement from the petitioner, causing unnecessary delays in processing.
The Service Center previously stated:
Until the Petition for Nonimmigrant Worker (Form I-129) and the Nonimmigrant Petition Based on Blanket L Petition (Form I-129S) are revised, USCIS recommends that all H-1B, L-1A, and L-1B petitioners include, as part of the filing packet, the new fee or a statement or other evidence outlining why this new fee does not apply. Ok, you know I love your pictures, so I played with curves and masking. Since I've been on the coast many times, I know those cliffs have a lot more detail than your photo, so I wanted to bring them out. I went for subtlety and not intensity in the color version. I don't know if it looked like this or not, but this is what I imagine it to be. Layering and adjusting curves can significantly change the "feel" of the picture to more closely emulate what you saw.
Also, I really like the BW version for dramatic feel. Michael Michael Michael.... you do such nice work... there's always a jewel in the center with a bit of tweakin... that's what I love about your work! Many possibilities with one pic! :)

I am currently on EAD and applied for I-485 in July 2007. My category is EB3 India.
I am also maintaing my H1-B status with current company. My priority date is December 2005.
As you all know about the situation of EB3 India and how long will it take to get to December 2005. I want to change the job as I am not getting paid as much as I am supposed to get considering my experience. I am also looking for some change and new opportunities.
So my question is if I get a contract job through a staffing agency and will be working for another company on contract and may be I get permanent after few months or may be not. Is it possible to work on contract for a company through staffing agency using my EAD? I never worked on contract my entire career so don't know anything about it.
What will I need to do or say when I go to staffing agency or the company I will be working for? what is the process?
Please advice as I know many of you have done this or know all about it.
Note: My wife is also on EAD( we applied for I-485 seperately) and not planning to move from the compay where she applied for GC.

Hi Friends,
I am visiting to India on vacation and need to go for H1B renewal. My natvie place is in Andhra Pradesh, near to Chennai. So, i am comming from USA to Chennai, and wants to go to Chennai Consulate for stamping.
In vfs site the moment i select AP, it showing only Hyderabad appointment dates. how to choose and schedule appointment in Chennai consulate?
Can any of you suggest, how to proceed? is there any issues of going to Chennai rather Hyderabad?

Dear All,
I got a labor substitution and filed for my I-140 and I-485 concurrently. Today was the last day to send the documents and some paperwork was missing for my wife! I missed sending the package!
Now how should i proceed?? My wife is on H1-B currently. Any ideas??
My priority date is 25 jan 05 - eb2.

If you missed this time around, you can apply 485 for your wife only when your PD becomes current. Your wife will have to continue working on her H-1B since EAD isn't an option anymore.
Just curious: what paperwork was missing as a result of which you missed this boat? I hope it wasn't trivial in the grand scheme of things.

I have a question regarding H1B transfer and should I go premium processing or not?
Here is my case:
I was laid of from Company A (not consulting) last week. I have all my past pay stubs. That was total shock to me and got me off-guard.. It took me few days to find a consulting company B which is willing to transfer my H1B.
As any big company, A is quite prompt in sending revoke letter so I would assume they would be already doing it by now. Company B will be sending transfer papers tomorrow(Friday) or Monday.
My question is should I go with Premium Processing or not? I just dont want to take any risk where USCIS denies my case. Is premium processing going to help me here or not.

My AOS was denied few months 4 months ago after I switched using AC21. Since my current employer has their own attorney (Pappas Lenzo in Boston) they filed for MTR and it is still pending. I was on my H1 which will expire in another 2 months. The attorneys are saying it takes time for MTR to be successful. But was not sure it would take this long.
Anyone has experience who filed I-485 MTR and it was successfull through this attorney.

After 90 days, you can open a service request. On another note if it is a AC21 write to Ombudsman too. Contact your congressman, they also help.
