Then the big C may have to deal with the Deeez in majority in congress. A democratic congress will pass a most liberal immigration bill they can imagine. The republicans will be far better served compromising now than waiting if democrats take congress. Right now the Dems, the Prez and the Senate are on the same page.

Hello Friends,
I have today booked my visa interview appointment at Mumbai consulate. My hometown is Indore (Madhya Pradesh) and on the visa appointment letter the "State of Residence" says "Maharashtra". I am confused whether I made any mistake or the "state of Residence" says maharashtra based on consulate's state?
Please help me getting answer to this puzzle.

This is a contract position to work in canada. This is normally through couple of vendors.
My employer is a small consulting company, which don't have own projects. So they pay only when I get project with other consultancies companies and bill through them.
You get work visa in canada then you need to be paid in canada..Work visa in canada has nothing to do with that of US status.
If you are getting paid in usa ( it seems like) and planning on working in canada on visitor visa its not legal. This might be the reason.
Your status in US has nothing to do with Working/Visiting/studying in Canada.
If you have used AP you "Probably" not on H1 any more.. there are some contradicting statements of IV members on this before. But I have seen USCIS sending a notice for one of my friend where in which he was advised to use AP ( as he is considered being on AOS eventhough he has H1) in future.

agiridhar,
I was sarcastic, if you didn't get it. INS/government always had monopoly over giving out of GCs(the constitution guarantees it for them). They never had competition about it. You're kidding yourself to think that you can sue them on anti-trust laws. Some other laws may be but definitely not anti-trust laws.

Here is an excerpt from the link below.. it sounds crazy
"Visa numbers can retrogress in the middle of a month and become unavailable without prior notice. If there is a mid-month retrogression, USCIS could elect to stop accepting adjustment applications. While this is unlikely to occur in July 2007, it becomes more and more possible as the fiscal year progresses. "
I hope this doesnt happen.

Well, my eye is initially drawn from top left to bottom right, and then there's nothing to see there. The colors are great, and the exposure is good. It's great when you get the sun's disk just so, and the clouds are really nicely lit... But I have to say the composition doesn't work with the sun down there in the corner, IMHO.

I am a resident working on H1b. Got married and wife joined me in July 2010.
1. First question in the ITIN form w-7 is: Reason you are submitting Form W-7. (there are couple of options)
Is the option in my case: "Spouse of U.S. citizen/resident alien"? (and it asks for the resident's i.e. my name and SSN.)
What are the other options
2. Item 6d. "Identification documents submitted" ?
Options are for passport, Divers License, USCIS documentation.
My wife has all the three. Her H4 visa is stamped and valid. What all should I submit?
Notorized copy of the passport which shows the valid visa...
Thx

The other day, three guys, a Pakistani, an Indian, and a Czech, and one Serb girl (originally from the beautiful city of Belgrade) met the staff of their American lawmakers, to tell them about the problems faced by the EB-immigrant community due to backlogs and insanely low visa numbers for EB-greencards.
You can't get more American than this.
My experience with the meetings with the lawmakers' staff has been very positive. I approached it with nervousness; however, the staff has ALWAYS been extremely polite, sincere and encouraging. They listen to us, and engage in meaningful discussions and question answer sessions with us. Quite often, we are told that this was the first time that our point of view was being told to them. We ask them what advice they have for us. And they all ALWAYS tell us to (a) talk to other lawmakers and (b) call them frequently, as they provide daily totals and tallys on pro-vs-anti calls on different issues to their bosses.
So folks. We still have time. We have a few weeks. Please (a) join together and form state chapters, (b) educate yourself, (c) call the lawmakers offices (d) meet the lawmakers and (e) do all this within the next few days.
Too often we take a fatalistic approach towards issues. Other times, nervousness and fear renders us incapacitated. Be proud of the fact that we are a diverse group of high-skilled immigrants. We are educated professionals. We are doctors, engineers, scientists, and other professionals.
It is our duty, as intelligent and educated professionals, to tell the lawmakers that we are facing problems, and to request them to fix those problems, since they have the power to do so.

My H1b expires Sep 2009 and can apply for extension from apr 2009 onwards(6 months ahead). If for some reasons the extension gets denied by around Jun 2009 will I have to leave the country immediately or am I valid till sep 30 2009 as per the original H1B. Is H1B transfer after the denial and before the i94 expiry date an option? Thank you.

Here is a quick update from the California Service Center regarding this new fee. The additional filing fees of $2,000 for certain H-1B petitions and $2,250 for certain L- 1A and L-1B petitions is applicable to petitioning employers who employ 50 or more employees in the United States and 50% of the petitioners employees are in H-1B, L-1A or L-1B status. The PL 111-230 fees do not apply to petitions requesting an extension of H-1B, L-1A or L-1B status with the same employer (only for initial filings for a new beneficiary).
When the fee is not required, it is critical that the petitioner explicitly acknowledge this and explain why it is not required in the I-129 filing. If this is not done, USCIS will likely issue a Request for Evidence asking for a statement from the petitioner, causing unnecessary delays in processing.
The Service Center previously stated:
Until the Petition for Nonimmigrant Worker (Form I-129) and the Nonimmigrant Petition Based on Blanket L Petition (Form I-129S) are revised, USCIS recommends that all H-1B, L-1A, and L-1B petitioners include, as part of the filing packet, the new fee or a statement or other evidence outlining why this new fee does not apply. USCIS requests that petitioners include a notation indicating whether or not the fee is required in bold capital letters at the top of the cover letter. The fee, statement, notation, or other evidence should be provided with each petition submitted. Where the fee or documentation is not submitted with the filing, or where questions remain, USCIS may issue a Request for Evidence to determine whether the additional fee applies to the petition. The following is a sample statement that the petitioner employer could use:
By this statement we confirm that our company (the petitioner) is not required to pay the H-1B filing fee under Public Law 111-230. Our business does not have more than 50 percent of our employees in the United States in H-1B or L-1 nonimmigrant visa status. Therefore, we are not required to pay the additional filing fee.
Please email me with any questions regarding the above referenced info.

Don't mean to pick on you but on the lighter side, El Paso is in US only :D. Things would be much easier if visa could be renewed in US itself.
Why not any of the consulates in Mexico ( Juarez, nogales, el paso etc). ...
- good luck
