Given the situation for 485 denial. AFAIK, You have an option of filing for H1B (not counted against quota) based on your B's labor approval and pending 140. Once you use the EAD, technically you don't have the H1B status to transfer or extend. Hence, it will require you to go to consulate (b/c approval will come without I94) to stamp, and start working for Company B after you return.

You can do that using your EAD but that could be considered a violation of H1 status. Not big deal if you do not need to maintain H1. If you want to keep H1, you cannot do that unless you are willing to re-validate H1 later on by leaving US and re-entering on H1.

I will file for my 485 this week. Next week I leave for India for 2 weeks. With the frontlog I wont get my 485 receipt this week. I have valid H1B. When I enter without 485 receipt will that be a problem? Will my 485 be abandoned in case there is problem? Please advice. Thanks.

Nothing stops you from changing your employer and submitting another H1 "transfer" with a transfer pending. This is called an anchor transfer. But beware that if the pending transfer is withdrawn by your former employer then USCIS will deny the newer transfer. I read about that somewhere but I don't have the link right now.

the question is about the type of visa needed to enter canada. I have pending I-485 in US but need visa to go to Canada. I have tourist visa for Canada but was wandering if I need to apply for a diferent visa to visit a client of my company for a few days. The reason of my visit is obviously not tourism...

I dont think there is one (at least legally). However, even if revoked, you may apply for new H1 (without quota bar, if you are within 6 years). The IO may or may not give you a new I94, so you may have to exit the country to get a new visa/I94.

I applied for H4 to H1 conversion (April'06) and then travelled to India (May'06). I came back on H4 (Jun'06). After one month my H1 was approved which includes a new I 94 valid from Oct'06.
Is this H1's I94 valid..?, as per law USCIS should abandon COS approval if alien travels out of U.S during its process.
Can I start my employment from Oct '06 or do I have to get my H1 stamped.

i send in my i-140/i485 along with those for my wife. as luck will have it, I forgot to include her sealed i-693. i am planning to send it tomorrow with a cover letter. is that okay? is there anything else I can do?

Yesterday I e-filed my EAD and AP renewal for me and my wife but I think I may have messed up a little.
1) I forgot to save the confirmation receipt( pdf) from me and now I cannot get it anywhere. I did it save it for my wife. I belive I need this along with the supporting documents. How Can I request the confirmation receipt from USCIS
2) I did not find any instructions come up for the list of supporting documents that need to be sent. Should I send the supporting documents (based on what I saw on this site) anyways?

According to CBC news, U.S. Army Pte. Bethany Smith fled Canada in September 2007 from a U.S. Army base in Fort Campbell, Ky. She applied for refugee status in October 2007, saying that she was harassed and threatened by fellow soldiers over her sexual orientation and feared that her life would be in danger if she were deported and returned to the army. The Canadian authorities initially rejected in her claim in February 2009. However, on appeal, the Federal Court of Canada held that the refugee board must reconsider the case again because the Board made several mistakes in initially reviewing her claim.
The Federal Court's decision (http://www.californiaimmigrationlawyerblog.com/Smith%20and%20the%20Minister%20of%20Citizenship%20 and%20Immigration.pdf)noted that the refugee board failed to fully consider the evidence pertaining to the situation of gays and lesbians in the U.S. Army to determine whether Pte. Smith could have availed herself of protection in the United States. The Federal Court also noted that the Board failed to determine whether Pte. Smith would be persecuted on account of her social group - as a lesbian in the U.S. Army if forced to return. There were other errors mentioned in the decision.

From everything I read, it appears that she wanted to serve in the U.S. Army and no real desire to leave the United States. At a time when we apparently need people to serve in the Armed Forces and in fact give non-citizens a way to immigrate to the United States faster for their service, it seems ridiculous that an American citizen should have to leave. I have changed my employer after 180 days of my pending I-485. I have not communicated USCIS about this. I was able to renew my EAD, and AP online with proper documentation without any issues.
I am planning to travel to India on Advance Parole now. Wondering if I can show my former employer's documentation such as I-485, I-140 approvals if anything arises while going or returning. Do you anticipate any issues with this? or do I need to carry any information about current employer, and my Job?. Appreciate your help.

I started my 10 hr./week part time job 2 years back (I was 4 years on my primary H1 by then). We filed a 2nd H1 and had no problems getting it approved - we got a 2 year approval aligned with the primary H1s 6 year expiry..
My both, the primary H1 and the 2nd H1 are up for renewal in Jan 07 & April 07 respectively and I am also up on the 6 years on my H1 by then.
I have an approved I-140 from my primary H1.
I have a question which I hope someone can help me answer. Will the 2nd H1 also qualify for the 3 year extensions, just like the primary H1 based on the I-140 approval on the primary H1?
